These SMS/Text Messaging Terms and Conditions (“SMS Terms”) govern participation in text messaging services offered by Elkhorn Logan Valley Public Health Department (ELVPHD).
These SMS Terms apply generally to ELVPHD SMS/text messaging programs. Individual ELVPHD programs or services may provide additional information regarding the specific messages participants can expect to receive.
ELVPHD may use SMS/text messaging to communicate with individuals who have provided a mobile telephone number and consented to receive applicable text messages.
Depending on the ELVPHD program, service, or activity, messages may include:
- Appointment, scheduling, or service reminders
- Class or program registration reminders and updates
- Program and service information
- Event or reservation information
- Public health announcements and service notices
- Community resource information
- Surveys or requests for feedback
- Responses to questions or requests for assistance
- Approved internal employee communications
- Other communications related to ELVPHD programs, services, or activities for which SMS communication has been authorized
ELVPHD may not use every type of communication listed above. The messages a participant receives will depend on the program, service, or activity for which the participant has enrolled or provided consent.
Participation in ELVPHD SMS/text messaging is voluntary.
Providing a mobile telephone number to ELVPHD does not, by itself, constitute consent to receive all ELVPHD text messages.
Where SMS consent is required, individuals will be provided an appropriate method to choose whether they wish to receive applicable text messages. Depending on the program or service, consent may be obtained through a registration or enrollment form, communication preference selection, keyword enrollment, or another ELVPHD-approved method.
By opting in to an ELVPHD SMS program, the participant agrees to receive text messages associated with the applicable ELVPHD program, service, or activity at the mobile number provided.
Consent to receive SMS/text messages is not a condition of receiving ELVPHD services unless specifically stated for a particular program or service.
Individuals should provide only a mobile telephone number that they are authorized to use.
Message frequency will vary depending on the ELVPHD program, service, or activity.
Participants may receive up to 3 messages per day, although actual message frequency may be lower and will depend on the applicable program or service.
Message and data rates may apply according to the participant’s mobile carrier and wireless service plan.
ELVPHD does not charge participants a separate fee for receiving SMS/text messages. Participants are responsible for any message, data, or other charges imposed by their mobile carrier or service provider.
Participants may stop receiving applicable ELVPHD text messages at any time by replying STOP to an ELVPHD SMS message.
Other standard opt-out keywords, including END, CANCEL, UNSUBSCRIBE, or QUIT, may also be recognized where supported by the applicable SMS service.
After submitting an opt-out request, the participant may receive a final confirmation message indicating that the request has been processed. No further messages associated with the applicable SMS program will be delivered unless the participant subsequently opts in again.
Participants may reply HELP to an ELVPHD text message for assistance where supported.

ELVPHD respects the privacy of individuals who participate in its SMS/text messaging programs.
Information collected in connection with SMS/text messaging will be handled in accordance with applicable ELVPHD policies, applicable law, and the ELVPHD SMS Privacy Policy.
Mobile telephone numbers, SMS opt-in information, and SMS consent information will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes.
ELVPHD may use service providers when necessary to operate, maintain, deliver, or support its SMS/text messaging services, subject to applicable privacy, security, contractual, and legal requirements.

Some ELVPHD programs and services may involve Protected Health Information (PHI) or other sensitive or confidential information.
Participation in an ELVPHD SMS/text messaging program does not automatically authorize SMS for the transmission of PHI or other confidential information.
Participants should avoid sending sensitive personal, financial, or health information by text message unless specifically instructed to do so through an ELVPHD-approved communication process.
ELVPHD’s use and disclosure of Protected Health Information is governed by applicable law, ELVPHD policies and procedures, and ELVPHD’s Notice of Privacy Practices.

Unless a specific ELVPHD SMS program is expressly identified as an emergency notification service, ELVPHD SMS/text messaging should not be relied upon for emergency assistance.
Individuals experiencing an emergency should contact the appropriate emergency services rather than relying on ELVPHD SMS/text messaging.
Delivery of SMS/text messages depends on wireless carriers, telecommunications networks, mobile devices, and other systems that may be outside ELVPHD’s control.
ELVPHD cannot guarantee that every message will be delivered or received within a particular period of time.
Wireless carriers are not responsible for delayed or undelivered messages.
Participants are responsible for providing accurate contact information. Participants should notify ELVPHD when appropriate if their mobile telephone number changes.
Availability of ELVPHD SMS/text messaging may depend on the participant’s mobile device, wireless carrier, service plan, and network availability.
SMS/text messaging may not be available through all carriers, devices, or service plans.
ELVPHD may modify or discontinue an SMS/text messaging program or update these SMS Terms as organizational, operational, technological, regulatory, or legal requirements change.
Updates to these SMS Terms will be posted on ELVPHD’s website with an updated effective date.
Continued participation in an ELVPHD SMS program following an update will be subject to the then-current SMS Terms, as applicable.
To the extent permitted by applicable law, ELVPHD is not responsible for delayed, failed, incomplete, or misdirected delivery of text messages resulting from circumstances outside ELVPHD’s reasonable control, including wireless carrier outages, telecommunications network failures, device issues, or inaccurate contact information provided to ELVPHD.
